Study in Germany Without a Visa: Your Residence Permit Guide (§ 41 AufenthV)

Can You Study in Germany Without Applying for a Visa First? For students from a small number of countries, the answer is yes. Thanks to § 41 of the German Residence Ordinance (Aufenthaltsverordnung — AufenthV), citizens of 14 specific nations can travel directly to Germany and apply for their student residence permit from within the country, skipping the embassy visa process entirely. 

What Does "Visa-Free Entry for Study Purposes" Actually Mean?

Most international students planning to study in Germany must apply for a national study visa (D-Visa) at a German embassy or consulate in their home country before they travel. This process can take several months and must be completed before departure. 

 

However, § 41 AufenthV creates an important exception. Citizens of certain countries are permitted to enter Germany using only their valid passport, just as they would for a short tourist stay, and then apply for their long-term student residence permit (Aufenthaltserlaubnis zu Studienzwecken, § 16b AufenthG) directly at the local immigration office (Ausländerbehörde) once they have arrived.

Important!: This privilege applies exclusively to the 14 countries listed below. If your country is not on this list, you must apply for a study visa through your nearest German embassy or consulate before travelling to Germany. There are no exceptions.

Which Countries Are Eligible Under § 41 AufenthV?

The following nationalities are the only non-EU/EEA citizens permitted to enter Germany and apply for a residence permit in-country for study purposes, as defined by § 41 of the Aufenthaltsverordnung. Please check this list carefully! Only passport holders of these countries qualify:

  • Andorra
  • Australia
  • Brazil
  • Canada
  • El Salvador
  • Honduras
  • Israel
  • Japan
  • Monaco
  • New Zealand
  • San Marino
  • South Korea
  • United Kingdom (including Northern Ireland)
  • United States of America

Step-by-Step: How to Apply for Your Residence Permit in Germany

If your country is on the § 41 AufenthV list, here is the process you will follow after arriving in Germany.

  1. Arrive in Germany.
    Travel on your valid national passport. No prior visa application is required. Make sure your passport is valid for the full duration of your intended studies plus at least three months beyond. 
  2. Register Your Address (Anmeldung).
    Within 14 days of moving into your accommodation in Berlin, register your address at the local Bürgeramt (Citizens’ Office). You will receive a registration certificate (Anmeldebestätigung), which is a required document for your residence permit application. 
  3. Open a Blocked Account (Sperrkonto).
    Before or shortly after arrival, open a German blocked account to demonstrate financial sufficiency. The current requirement is €11,904 per year (approximately €992 per month). Popular providers include Fintiba and Expatrio. 
  4. Take Out Private Health Insurance.
    You must have valid health insurance coverage in Germany before your residence permit is issued. Students not yet enrolled in public German health insurance (gesetzliche Krankenversicherung) must hold private health insurance in the interim. BIC can advise you on approved providers. 
  5. Apply for Your Residence Permit Within 90 Days.
    You have 90 days from the date of your entry into Germany to submit your residence permit application at the Berlin Ausländerbehörde (Immigration Office). While your application is being processed, you will receive a temporary document confirming your legal right to remain in Germany during the review period.

What Documents Will You Need?

The documentation required for a student residence permit under § 16b AufenthG is similar to that of a standard visa application. Prepare the following before your appointment at the Ausländerbehörde:

  • Valid passport — must be valid for at least three months beyond your planned stay 
  • Biometric passport photos — two recent photos meeting German biometric specifications with a QR code as confirmation. This can be done at a local DM store. 
  • Proof of enrolment — official letter from Berlin International College confirming your admission and enrolment 
  • Proof of financial resources — blocked account statement showing at least €11,904 (or equivalent alternative proof such as a scholarship letter) 
  • Health insurance certificate — valid German private or public health insurance — this must be active before your appointment 
  • Proof of address registration — your Anmeldebestätigung from the Bürgeramt 
  • Completed application form — the Ausländerbehörde Berlin application form (BIC will help you with this) 
  • Application fee — currently between €56-€100 for a residence permit depending on type of student study permit (subject to change) 

⚠  Key reminder:  The blocked account and private health insurance are the two documents that most commonly cause delays. Make sure both are in place before you submit your application. 

The 90-Day Deadline — Don't Miss It!

This is the single most important deadline you will face as a § 41 AufenthV student. You must submit your residence permit application within 90 days of first entering Germany. After 90 days, your visa-free stay period expires and remaining in Germany without a valid residence title or application receipt (Fiktionsbescheinigung) is unlawful.
